These Terms and Conditions ("Terms") constitute a legally binding agreement between the User ("You" or "Your") and Alakmalak Technologies Pvt Ltd ("We," "Us," "Our," or "PsychicSouls"), governing Your access to and use of Our website, mobile application, and any related services ("Services").

By accessing or using the Services, You agree to be bound by these Terms. If You do not agree, please refrain from using the Services.

1. GENERAL DESCRIPTION OF THE SERVICE

PsychicSouls is an online marketplace designed to connect users seeking psychic advice with independent professional psychic advisors ("Advisors"). We provide a platform where Users can engage with Advisors through text, video, or voice for personal guidance.

PsychicSouls neither directly provides psychic advice nor guarantees the accuracy or efficacy of the information provided by Advisors. All services are for entertainment purposes only.

2. USER ELIGIBILITY AND REGISTRATION

Eligibility:

• You must be at least 18 years old and capable of entering into legally binding contracts under the Indian Contract Act, 1872.
• Use of the Service is prohibited in jurisdictions where it violates local laws or regulations.
• Use of Services by minors is not permitted; however, questions related to minors in a User's family may be asked under specific circumstances.

Registration Requirements:

• Users must register with accurate, current, and complete information.
• Users are responsible for maintaining the confidentiality of their login credentials and for all activities conducted under their account.
• Multiple accounts for a single User are strictly prohibited.
• Users must report suspicious activity immediately.
• Users must not share accounts or credentials.

Misuse and Termination:

• Providing false or incomplete information may result in account suspension or termination.
• PsychicSouls reserves the right to suspend or terminate any account in cases of misuse, fraudulent behavior, or violation of these Terms.

Company may terminate or suspend:

• Without notice.
• For any reason.
• Without refund.
• With immediate effect.

All obligations survive termination.

Upon termination:

• Access is revoked immediately.
• Credits are forfeited.
• Content may be deleted.
• No refunds are issued.

Users shall not:

• Share personal contact information.
• Engage in harassment or abuse.
• Post illegal or offensive content.
• Attempt to circumvent platform fees.
• Make false representations.
• Create multiple accounts.
• Manipulate ratings or reviews.
• Engage in fraudulent activities.

3. NATURE OF ADVISOR RELATIONSHIPS

Independent Advisors:

Advisors are not employees, agents, or representatives of PsychicSouls. They operate independently and are solely responsible for the services they provide.

User Responsibility:

• Users must use discretion in selecting Advisors and determining the suitability of the advice provided.
• PsychicSouls does not endorse or guarantee the qualifications or effectiveness of any Advisor.

Prohibited Interactions:

Users and Advisors are strictly prohibited from sharing personal contact information (e.g., phone numbers, email addresses) or engaging outside the platform.

4. PAYMENT, REFUNDS, AND CANCELLATIONS

Payment:

• Payments for services are facilitated through third-party payment gateways. PsychicSouls does not store credit card or payment information.
• All fees are final and non-refundable unless explicitly stated otherwise.
• The company may modify rates without notice.
• Promotional credits may expire.
• Chargebacks may result in account termination.

Refund Policy:

Refunds are only considered under specific circumstances, including:

• Technical issues interrupting services (e.g., call or chat disruptions) if reported within 7 days of the occurrence.
• Advisor failure to deliver services due to language barriers or inappropriate responses.

Refunds, if approved, may take up to 15 working days to process and will be credited to the User's PsychicSouls wallet, not refunded directly. All refund decisions are final and at the Company's sole discretion.

5. USER RESPONSIBILITIES AND PROHIBITED CONTENT

Conduct:

Users agree not to post or share any content that:

• Violates any laws, copyrights, trademarks, or intellectual property rights.
• Contains offensive, defamatory, abusive, or hateful material.
• Encourages criminal activities or breaches public policy.

Prohibited Activities:

• Harassment, abuse, or exploitation of Advisors or other Users.
• Sharing obscene or inappropriate content.
• Attempting to bypass the PsychicSouls platform for direct engagement with Advisors.
• Using bots or automated tools to access the platform.

Reporting Violations:

Users are obligated to report any misuse or violations of these Terms. PsychicSouls reserves the right to investigate and take necessary actions, including termination of accounts.

6. PRIVACY POLICY AND DATA USAGE

User Data:

By using PsychicSouls, You consent to the collection, storage, and processing of personal data as outlined in Our Privacy Policy.

• PsychicSouls is committed to maintaining data security and transparency in compliance with applicable laws, including India’s Information Technology Act, 2000.
• Live sessions (calls, video, or chats) may be monitored or recorded for quality assurance or safety reasons.

Third-Party Access:

Limited access to User data may be granted to Advisors for service delivery. No User financial information is shared with Advisors.

7. LIMITATION OF LIABILITY AND DISCLAIMERS

• All services are for entertainment purposes only. PsychicSouls does not warrant the accuracy, reliability, or applicability of advice provided by Advisors.
• Advisors do not provide medical diagnoses, financial recommendations, or legal counsel.

Liability Limitation:

PsychicSouls is not responsible for:

• Losses arising from the use of services.
• Technical disruptions, data breaches, or unauthorized account use.

Liability is limited to the amount paid by the User for services within the past 2 months or Rs. 5000, whichever is less.

8. FORCE MAJEURE AND SERVICE INTERRUPTION

• PsychicSouls is not liable for interruptions due to natural disasters, pandemics, government actions, or technical failures.

9. INTELLECTUAL PROPERTY RIGHTS

All content, trademarks, and materials on the PsychicSouls platform are proprietary and owned by Alakmalak Technologies Pvt Ltd.

10. GOVERNING LAW AND JURISDICTION

This agreement is governed by the laws of India. Any disputes shall be resolved through arbitration under the Arbitration and Conciliation Act, 1996, with proceedings held in Ahmedabad, Gujarat, India.

11. MODIFICATIONS TO TERMS

PsychicSouls reserves the right to update or modify these Terms at any time without prior notice.
